BHOPAL: A judge in MP’s Narmadapuram district, who on Saturday awarded the death penalty to a man convicted of raping and murdering a six-year-old girl, wrote a poem in the judgment to capture the agony and injustice suffered by the child victim.
Speaking as the victim herself, special judge Tabsum Khan wrote, “Han, main hun Nirbhaya, phir ek Nirbhaya…” The moving poem ends with the lines: “Ek chhota sa prashn utha rahi hun, jo nari ka apman kare, kya who mard ho sakta hai (I have a small question, one who insults women, can he ever truly be a man)?”
Judge Khan of the additional sessions court in Seoni Malwa delivered the verdict in less than three months, adding the poem as part of the judgment.
The judge wrote about the pain of the victim in her last moments: “He took me away in my sleep like the dark shroud of death… I was alone and very scared… I sobbed and called out for my parents, I cried and screamed for help, but no one heard… he too was the father of three children, so why did he do this to me?”
Child rapist-killer wanted girl’s dad to exchange her for his son
On the night of Jan 2 this year, Ajay Vadiba kidnapped the child in her sleep. The family searched the entire village, but found no trace of her. Police zeroed in on Ajay during their probe and took him into custody.
During interrogation, he admitted to raping and killing the girl. He claimed that he had requested the girl’s father to exchange his daughter for his son. The girl’s father dismissed it as a joke, but Ajay had a sinister plan in mind. He took her to a secluded location, where he raped and murdered her, and threw the body near a canal.
The body was found the next morning, triggering anger and outrage. Family members and villagers placed the body on a busy road and held a protest for two hours, holding up traffic. After arresting Ajay, police fast-tracked the probe.
The chargesheet was presented in court on Jan 13 – just 11 days after the crime. The trial lasted 88 days, and 33 pieces of evidence were presented. The prosecution presented 39 witnesses in court, all of whom corroborated the incident. The DNA report also came back positive.
Ajay was convicted under BNS and Pocso Act for abduction, rape and murder of a child and sentenced to death. In addition, he was fined Rs 3,000 and ordered to pay a compensation of Rs 4 lakh to the victim’s family.
Special public prosecutor Manoj Jat represented the govt.
