Madras HC Denies Request for New Bypass Road Amid Traffic Woes in Tuticorin | Madurai News

MADURAI: The Madras high court dismissed a plea moved by a man seeking a direction to the authorities to lay a road in Tuticorin district.The court was hearing a public interest litigation filed by S M A Pon Gandhimathinathan, a resident of Tuticorin district. The petitioner sought a direction to the authorities to lay a two-way bypass road and refurbish the 40 km bitumen road between Tuticorin and Tiruchendur. This was intended to mitigate perennial traffic congestion and facilitate the movement of pedestrians and devotees to the Tiruchendur Murugan Temple.A division bench of Justice S M Subramaniam and Justice A D Maria Clete observed that the nature of the relief sought in this petition pertains to a policy decision to be made by the govt. Such policy decisions, involving significant financial commitments, are to be taken at the govt level after considering various factors. Therefore, the high court, in the exercise of its powers of judicial review, cannot issue a direction to lay or relay the roads, which involve huge expenditure, the judges observed and dismissed the petition.
